Conditions of entry and stay of foreign workers 

A foreigner who intends to work in Lithuania must obtain a work permit. Issue of work permits to foreigners depends on the labour market demand in Lithuania. The work permit may be issued to a foreigner if there is no specialist in Lithuania meeting the employer’s qualification requirements. A work permit is issued by the Labour Exchange under the Ministry of Social Security and Labour of the Republic of Lithuania. Employer, who is willing to employ an alien, has to register a job vacancy in the local labour exchange, which is in the same district where the headquarters of the company are registered. Local labour exchange is obliged to look for a required specialist in Lithuania for the period of one month. If local labour exchange is unable to find a specialist with required qualification the employer is entitled to submit an application regarding the issuance of work permit for an alien that should be examined within two months from the date of receipt of the application by the Lithuanian Labour Exchange. A work permit must be obtained before entering Lithuania. Validity of a work permit:

work permit is issued for a period of up to 2 years specifying the job (position) and the company, institution or organization where the foreigner will be employed;

a foreigner who takes up seasonal employment obtains a work permit valid for up to 6 months during a single year starting from the first day of entry into Lithuania;

a foreigner who comes to Lithuania for an internship or practical training receives a work permit valid for 1 year, which may be in extended in exceptional when the duration of internship or traineeship is longer and the extension is necessary to acquire qualification in a certain field.

 

Documents Required for a Work Permit to be Issued 

Employer who is willing to employ an alien has to submit an application with required documents to the same local labour exchange where the job vacancy was registered.

When employer needs a work permit for an alien whose permanent place of employment is in a foreign country and the alien is sent for temporary employment in the Republic of Lithuania the following documents have to be submitted:

1.   Application of the set form;

2.   Copy of passport or a corresponding document for going to a foreign country acknowledged in the Republic of Lithuania;

3.   Document confirming aliens’ permanent place of residence;

4.   Diploma or other document proving aliens’ qualification legalized or approved by Apostille;

5.   Certificate of the competent institution about the acknowledgement of vocational qualifications if the profession is regulated in the Republic of Lithuania. The information on the professions regulated in the Republic of Lithuania is provided by the Lithuanian Center for Quality Assessment in Higher Education;

6.   Contract between the companies;

7.   An individual employment contract between alien and his permanent employer;

8.   Description of the working position which an alien is going to take.

When employer wants to employ an alien on the basis of an individual employment contract there should be submitted:

1.   Application of the set form;

2.   Copy of passport or a corresponding document for going to a foreign country acknowledged in the Republic of Lithuania;

3.   Document confirming aliens’ permanent place of residence;

4.   Diploma or other document proving the aliens’ qualification legalized or approved by Apostille;

5.   Certificate of the competent institution about the acknowledgement of vocational qualifications if the profession is regulated in the Republic of Lithuania. 6.   Document proving aliens’ experience;

All the documents have to be translated in to Lithuanian language and approved by notary or another order of the same status.

Exempting an Alien from the Obligation to Obtain a Work Permit 

An alien shall be exempt from the obligation to obtain a work permit if:

1.     the alien holds a permanent residence permit;

2.     the alien holds a temporary residence permit issued under following conditions:

  • the alien has retained the right to citizenship of the Republic of Lithuania in the manner prescribed by the Law on Citizenship of the Republic of Lithuania;
  •  the alien is a person of Lithuanian descent;
  • in a case of family reunification;
  • the alien has been put under guardianship/curatorship or has been appointed guardian/curator;
  • the alien has been granted subsidiary protection in the Republic of Lithuania in the manner prescribed by The Law on the Legal Status of Aliens;
  • the alien has been granted temporary protection in the Republic of Lithuania in the manner prescribed by The Law on the Legal Status of Aliens.

3.     According to the Order of the Minister of Social Security and Labour No A1 - 118 of 24 April 2006, an alien is exempted from obligation to obtain a work permit when:

  • The alien as owner or joint owner establishes a company, institution or organization in the Republic of Lithuania and posses 10 or more percent of the authorized capital of the company or a part of the voting rights , and his residence in the Republic of Lithuania is necessary to pursue the goals and carry out the activities of the company, institution or organization;
  • The alien is an executive or an authorized representative of a company, institution or organization established in the Republic of Lithuania and the main goal of his residence is work in that company, institution or organization;
  • The alien comes to the Republic of Lithuania to arrange negotiations regarding the conclusion of a contract or its’ implementation, personnel training, commercial setting – up, installation of the equipment or similar activities for a period not exceeding three months per year;
  • The alien is a legal resident of one of the European Union countries legally working there and sent for temporary work to the Republic of Lithuania with an official certificate of competent institution of European Union confirming his social insurance;
  • The alien working in the company of third country has concluded an agreement to provide services in the Republic of Lithuania when the country there the company is established within the framework of World Trade Organization concluded bilateral or multilateral international agreement with the European Union on the conditions for natural persons to provide services and following agreement is in force for the Republic of Lithuania. Aliens are exempted from obligation to obtain work permits due to Lithuania’s responsibilities in the above – mentioned international agreement to exempt aliens from obligations to obtain work permits (according to the spheres of services provision or quota);
  • The alien is providing services in the third country has concluded an agreement to provide services in the Republic of Lithuania when the country there the services are provided within the framework of World Trade Organization concluded bilateral or multilateral international agreement with the European Union on the conditions for natural persons to provide services and following agreement is in force for the Republic of Lithuania. Aliens are exempted from obligation to obtain work permits due to Lithuania’s responsibilities in the above – mentioned international agreement to exempt aliens from obligations to obtain work permits (according to the spheres of services provision or quota);
  • The alien is willing to work in the Republic of Lithuania in order to implement joint programs of the Lithuanian Government with foreign countries;
  • The alien is a professional sportsman or coach who has concluded a contract for the activities of sports (Article 30 of Republic of Lithuania Law on Physical Culture and Sport (“Official Gazette”, 1996, No 9-215);
  • The alien comes to Lithuania to carry out scientific research or take up a teaching position at the institutions of higher education;
  • The alien comes as a probationer or trainee for a period not exceeding three months per year;
  • The alien is a member of the traditional Lithuanian religious association (community) or religious association acknowledged by the state, who has a certificate of mediation issued by the authority of that religious association (community), is a priest of other religious association (community) with the status of a legal person in the Republic of Lithuania, who has a certificate of mediation issued by the authority of that religious association (community) and supported from the funds of the religious community during his stay and religious activities in the Republic of Lithuania (Article 17 of Republic of Lithuania Law on Religious Communities and Associations (“Official Gazette”, 1995, No 89-1985);
  • The alien is a long term resident of the European Union living and working in the Republic of Lithuania for a period of one year on the basis of a work permit and temporary residence permit and willing to conclude individual employment contract;
  • The alien is a representative of a foreign charity organization whose propose of residence is to provide charity;
  • The alien is a member of volunteer programs sponsored or encouraged by the European Union or its’ member states.

Time Limits for Examining an Application to Issue a Work Permit

Alien’s application issue a work permit in the Republic of Lithuania shall be examined within two months from the date of receipt of the application at the local labour exchange when an alien pursues employment in the Republic of Lithuania under an employment contract, if the alien is sent for temporary employment in the Republic of Lithuania when alien’s permanent place of employment is in a foreign country or the alien is highly qualified application issue a work permit in the Republic of Lithuania shall be examined within one month from the date of receipt of the application at the local labour exchange.

Validity of a Work Permit 

A work permit shall be issued to an alien for a period of up to two years specifying the job (position) and enterprise, agency or organisation where the alien will be employed. Work permit issued to an alien sent on secondment can not exceed one year. Work permit issued to an alien working on the basis of individual working contract can not exceed two years.

An alien who enters the Republic of Lithuania to take up seasonal employment shall be issued a work permit for an up to six-month period in a year from the first day of entry in the Republic of Lithuania.

An alien who enters the Republic of Lithuania for employment as an intern or trainee shall be issued a work permit for a period of one year and its period of validity may be extended on an exceptional basis, when the period of internship or traineeship is longer than one year and the extension is necessary for acquiring qualification in an appropriate area.

Charges for a Work Permit 

To get a work permit a receipt or a copy of payment transfer certifying that the fee has been paid to the State Tax Inspectorate has to be provided to the Lithuanian Labour Exchange with. The fee, which now is 420litas for issuance of a one – year permit and 520 litas for a two – year permit, can be paid at any Vilnius branch of stock company Swedbank or by a payment transfer for Swedbank, account No LT 24 7300 0101 1239 4300, purpose of payment – 5710.

Entry into Employment by Aliens: 

An employer may conclude a contract of employment only with an alien in possession of a work permit, except the cases when an alien is exempted from obligation to obtain a work permit.

An employment contract must be concluded with an alien in accordance with a set form of the employment contract approved by the Resolution of the Government of the Republic of Lithuania No 115 of 28 January 2003 (“Official Gazette”, 2003, No 11-412).

An employment contract should be concluded in two copies – in the Lithuanian language and a language that an alien understands.

An employment contract with an alien has to be fixed term and an not exceed the period of validity of the work permit issued to an alien.

An employment contract should indicate the job (position) and the period of employment of the alien as compulsory conditions.

An alien’s pay shall not be less than that paid to a resident of the Republic of Lithuania for performing equal work. 

N. B. Employer is obliged to submit employment contract signed by both parties and a copy of employment contract to the Lithuanian Labour Exchange within one month days from the day work permit has been withdrawn.

An alien’s employment relationship shall be regulated by the Labour Code of the Republic of Lithuania, this Law and legal acts of the European Union.

If the employment contract is terminated prior to the end of the term of the contract then employer is obliged to officially notify Lithuanian Labour Exchange and the Migration Department under the Ministry of the Interior within 7 days.

Grounds for Rejecting and Withdrawing a Permit to Work in the Republic of Lithuania 

Grounds for rejecting a work permit:

A work permit shall be issued to an alien taking into account the needs of the Lithuanian labour market;

Not all required documents have been submitted;

The foreigner or the employer has presented false, incomplete or not exhaustive data.

Grounds for abolishing a work permit:

An alien’s work permit shall be withdrawn:

1) if the permit has been obtained by fraud;

2) upon the termination of the alien’s contract;

3) in case of termination of employment by the employer in a foreign country, who had sent the alien for temporary employment in the Republic of Lithuania;

4) the alien’s temporary residence permit is withdrawn.

Family reunification 

The spouse of a non-EU national (or the person who has concluded partnership agreement with the non-EU national), the unmarried and dependent children of the couple or of one of them (adopted children) below the age of 18 years, may enter into Lithuania for purposes of family reunification with the foreigner who has been lawfully residing in Lithuania for a continuous period of at least 2 years. Asylum seekers and persons granted subsidiary or temporary protection in Lithuania are not entitled to family reunification. There may be a waiting period of no more than three years between the submission of the application for family reunification and the issue of a residence permit to the family members. The conditions for the submission of the aliens’ applications for family reunification and the procedure for the examination is established by the Minister of Interior.
